Meyers & Flowers Secures Full Verdict, Delay Damages, and Post-Judgment Interest in Maragos Case
CHICAGO, IL – January 2025 – Meyers & Flowers is proud to announce the final resolution on the landmark case on behalf of former Philadelphia Eagles team captain Chris Maragos. Achieving a settlement that includes the full jury verdict, as well as delay damages and post-judgment interest against Rothman Orthopaedics. This marks the end of a hard-fought legal battle on behalf of the former NFL player, whose professional football career was prematurely ended due to medical negligence.
Since the jury delivered its historic verdict in 2022, Rothman Orthopaedics pursued a series of appeals in an effort to overturn the decision. First, they filed an appeal with the trial judge to reverse the verdict, but this was denied. They then appealed to an appellate court panel, which also upheld the verdict. Unsatisfied, Rothman sought a review by the entire appellate court, but this request was denied as well. Finally, they attempted to take the case to Pennsylvania’s Supreme Court. Before the appeal could reach the highest court, Rothman decided to settle the case and withdraw its appeal. After years of delays, Meyers & Flowers successfully recovered the full verdict, including all accrued delay damages and post-judgment interest.
“This case was not only about compensating Chris Maragos for the devastating loss of his career but also about holding medical professionals accountable for the standard of care owed to their patients. said Peter J. Flowers, Founding Partner at Meyers & Flowers. “Justice has finally prevailed, and we are honored to have stood by Chris and his family throughout this journey,”
“This case highlights the critical importance of putting the athlete’s health above the interests of the team or any external pressures. Medical providers have a duty to deliver care that prioritizes the individual’s well-being, and when that trust is broken, the consequences can be devastating.” said Frank V. Cesarone, Partner at Meyers & Flowers.
Case Overview
The case centered around a right knee injury sustained by Chris Maragos during an NFL game on October 12, 2017, which ultimately led to the premature and unnecessary end of his professional football career. Although diagnosed immediately, the torn and extruded meniscus injury was mismanaged by renowned orthopedic surgeon Dr. James Bradley and multiple doctors from Rothman Orthopaedics.
Key evidence presented during the trial revealed:
- A failure to address and repair a meniscus tear causing permanent damage to Maragos’ knee.
- The creation of two separate medical charts, one of which omitted critical information.
- The negligent advancement of Maragos’ rehabilitation, despite MRI evidence and clinical evidence of a worsening condition, resulting in irreversible harm.
Meyers & Flowers attorneys Peter J. Flowers and Frank V. Cesarone, along with Dion G. Rassias and Jill Johnston of The Beasley Firm, successfully argued the case and secured the record-setting verdict.
