$1.8 Million Resolution for 42-Year-Old Will County Man Struck by ComEd SUV
On April 24, 2017, David was riding his bicycle on 135th Street in Plainfield, Illinois, when a ComEd SUV suddenly and unexpectedly crashed into him, causing David to become trapped underneath the SUV. After several terrifying minutes, David was extricated from beneath the vehicle and transported to a local hospital in critical condition.
David suffered numerous injuries, including an epidural hematoma, which required an emergency craniotomy to save his life and control the bleeding that was compressing David’s brain. David endured a painful and protracted recovery and continues to suffer from the effects of his traumatic brain injury to this day.
On the recommendation of a friend, David’s family reached out to Michael Lenert, a partner at Meyers & Flowers. “After interviewing several attorneys, it was clear that Mike was the attorney I wanted to represent me,” David said. “His attention to detail, ability to ease my concerns, and commitment to aggressively prosecuting my claim from the outset made my decision to hire him an easy choice.”
After more than two years of litigation, Mike, working with fellow Meyers & Flowers Partner Craig Brown, was able to defeat the numerous liability defenses raised by ComEd while also establishing the long-term effects of David’s traumatic brain injury.
“In order to maximize David’s recovery, especially with relatively little medical bills and no wage loss claim, it was critical that we establish the permanent deficits resulting from David’s brain injury,” said Lenert. “Through the depositions of his medical treaters and the opinions of our retained experts, we were able to establish the difficulties David will face for the remainder of his life due to the negligence of the defendant.”
“Traumatic Brain Injury cases like David’s are challenging because many times there is no X-ray or MRI that shows the brain was injured,” said Brown. “We are pleased we were able to convince ComEd that a jury would have awarded a large verdict in this case even though David was able to return to work as a teacher.”
This settlement will help David, a teacher and father of three, rebuild his life as he continues his recovery. According to David, “Mike’s guidance through the most difficult journey of my life was invaluable. This settlement allows my family and I to move forward and close this chapter once and for all.”
